Terms and Conditions

1. Provider and scope

These terms apply to all orders placed with Framewerk, Onur Saldik, Dresdener Weg 23, 71672 Marbach am Neckar, Germany ("we"). Differing terms of the customer do not apply. Contact: info@framewerkpc.com.

2. Services

We optimize Windows PCs for gaming in a live remote session (e.g. Windows Quick Assist). The exact scope follows from the package booked, as described on our website at the time of the order. Additional games and special requests are only included if agreed in advance. Hardware repairs are not included.

We owe careful performance of the service, but no specific performance gain. How much FPS, 1% lows or latency improve depends on hardware, software and games. That is why we measure before and after and share the result with you.

The Complete package includes 14 days of follow-up support from the day of the session. It covers help with questions and problems related to the optimization carried out, not a new full session.

3. Conclusion of the contract

The presentation of the packages on our website is not yet a binding offer. In the order form you choose a package and an appointment, enter your details and can review and correct everything before sending. By clicking the button "Order with obligation to pay" you make a binding offer. The contract is concluded when we confirm your order by e-mail. The contract language for orders on framewerkpc.com is English. You receive the order details and these terms with the confirmation by e-mail.

You must be at least 18 years old or have your parents' consent to order. You may only have a PC optimized that you are entitled to use, or for which you have the permission of the person entitled.

4. Prices and payment

The price shown before you send your order applies. All prices are final prices. No VAT is charged under the small business scheme (Section 19 German VAT Act).

Payment is made in advance by bank transfer to the account stated during the order. It must reach us at the latest one day before the appointment. You receive the invoice by e-mail after your payment has arrived. If payment does not arrive in time, the session does not take place, and we may cancel the order after informing you by e-mail. We refund any amount received later, unless a new appointment is agreed.

5. Rescheduling or cancelling an appointment

You can reschedule or cancel your appointment free of charge up to 24 hours before it starts. An e-mail to us is enough. If you cancel, we refund amounts already paid in full.

If you cancel later, or if you are not reachable and ready within 15 minutes after the start of the appointment, you receive one new appointment free of charge. If this happens again at the new appointment, we may keep 50% of the price as compensation for the time reserved and refund the rest. You remain free to prove that we suffered no loss or a lower loss. Your statutory right of withdrawal is not affected by this rule.

If we cannot keep an appointment, e.g. due to illness, we inform you as early as possible and offer a new appointment. If no new appointment suits you, we refund the full amount.

6. Your cooperation

For the appointment, you make sure you have a stable internet connection and administrator rights on the PC, and you stay reachable during the session. You back up important data beforehand. We create a restore point before making changes; this does not replace a data backup. You close confidential content before the session. We never ask for passwords.

7. Stopping the session

You can end the session at any time. If you stop it for a reason we are not responsible for, you pay the share that corresponds to what has been performed compared with the full scope, and you get the rest back.

If the optimization is technically not possible or the session ends for a reason we are responsible for, we refund the full amount. Refunds are made without undue delay, at the latest within 14 days, to the account the payment came from.

8. Defects

The statutory rights apply. Please report problems as soon as possible so that we can check and fix them.

9. Liability

We are liable without limitation for intent and gross negligence, for injury to life, body or health, and under the German Product Liability Act. In the case of slight negligence, we are only liable for the breach of essential contractual obligations, meaning obligations whose fulfilment makes the contract possible in the first place and on which you may rely. In this case, liability is limited to the foreseeable, typical damage. For data loss, it is also limited to the effort that would have been required to restore the data with a customary backup.

10. Right of withdrawal and data protection

Consumers have a statutory right of withdrawal. Details are in the notice on the right of withdrawal. How we handle data is described in the privacy policy.

11. Dispute resolution and final provisions

We are neither willing nor obliged to take part in dispute resolution proceedings before a consumer arbitration board. German law applies. Mandatory consumer protection provisions of the country in which you have your habitual residence remain unaffected. If a provision is invalid, the rest of the contract remains valid.
